Alternative Dispute Resolution

Alternative Dispute Resolution (ADR) covers a wide range of processes aimed at resolving disputes: mediation, arbitration, and conciliation. The process involves an independent third party helping you and the company reach a resolution.

Mediation

Mediation involves a neutral mediator who facilitates communication between disputing parties to help them reach a voluntary agreement. In mediation, the mediator proposes a solution but has no decision-making power, meaning it’s not legally binding. It is only a recommendation.

Conciliation

Similar to mediation, conciliation involves a neutral third party, the conciliator, to help resolve the dispute. However, the conciliator may propose solutions, and, depending on the context, the agreement reached may be binding or non-binding. Conciliation is less formal than arbitration.

Arbitration

In arbitration, a neutral third party, the arbitrator, listens to both sides of the argument and examines the evidence from each side, before making a legally binding decision. It is a more formal process, which is sort of like a simplified court proceeding.
